1. Definitions

In these General Terms and Conditions, the following definitions apply:

  • 1.1 The Entrepreneur: The natural or legal person who enters into an agreement regarding the provision of training, diving courses, first aid courses, CPR, oxygen administration, bloodborne pathogens, or other courses/products offered. This refers to DIB Diving.

  • 1.2 Consumer/Client/Participant: A natural person who does not act in the course of a profession or business and who enters into an agreement with the Entrepreneur concerning a product and/or service and/or course and/or training offered by the Entrepreneur.

2. General

  • 2.1 These General Terms and Conditions apply to all offers, quotations, agreements, and deliveries of services and products by or on behalf of the Entrepreneur.
  • 2.2 Deviations from these General Terms and Conditions are only valid if expressly agreed by both parties in writing.
  • 2.3 If one or more provisions of these General Terms and Conditions are at any time wholly or partially invalid or declared void, the remaining provisions of these General Terms and Conditions shall remain fully applicable.

3. Participant’s Obligations

  • 3.1 Each course describes the requirements and conditions that the participant must meet to be allowed to attend the course. The relevant forms can be found with the course description and are assumed to have been read by the participant prior to purchasing the course. The relevant forms may include:
    • SDI – General Liability Waiver and Risk Acceptance
    • SDI – Medical Statement
    • SDI – Standards for the respective course
    • Possibly other forms

    The participant is responsible for meeting the requirements and conditions. The Entrepreneur will assist the participant where possible. If forms are not available in Dutch and the participant requires a translation, this can be requested from the Entrepreneur.

  • 3.2 The participant may only attend the course if the relevant forms (if applicable) have been completed truthfully, signed, and submitted to us before or on the first day of the course. If the participant cannot answer ‘no’ to every question on the medical statement, the participant must provide a statement from a (diving) doctor approving participation in the course. If it becomes apparent during the course that the medical statement was not completed truthfully, the Entrepreneur will immediately terminate the course, and the right to a refund will lapse. After approval by a recognized (diving) doctor, the course may be resumed. Additional costs for catching up on missed sessions will be borne by the participant. For individuals under the age of 18, the parent or guardian must sign the necessary forms.
  • 3.3 Upon request, the participant must show the forms. If the participant cannot present these forms, the Entrepreneur may exclude the participant from the course without being liable for (damage) compensation.
  • 3.4 The Entrepreneur may rely on the accuracy of the information provided by the participant.
  • 3.5 The participant must handle the (diving) equipment provided by the Entrepreneur with care. If the provided (diving) equipment is lost or damaged, the Entrepreneur may charge the participant for the damage.
  • 3.6 The participant will adhere to the rules and protocols of the Entrepreneur, the house rules of the pools used during the pool lessons and other rules or laws of the locations used during training. The participant will follow the instructions of the instructors during the course.

4. Offer and Agreement

  • 4.1 All offers from the Entrepreneur are non-binding unless expressly stated otherwise.
  • 4.2 The agreement is concluded when the consumer accepts the offer from the Entrepreneur and meets the stipulated conditions.
  • 4.3 The Entrepreneur will confirm the agreement in writing or electronically to the consumer.

5. Prices and Payment

  • Prices for the offered services and products are in euros and include VAT, unless stated otherwise.
  • Payment must be made within 14 days of the invoice date, unless otherwise agreed in writing.
  • If the consumer fails to make timely payment, the consumer is in default by operation of law. The consumer then owes statutory interest.
  • It is not possible to start a course or e-learning before full payment has been received.

6. Cancellation and Changes

  • 6.1 Cancellation of a course by the consumer must be done in writing.
  • 6.2 In case of cancellation up to and including 14 days before the start of the course, 50% of the course fees will be charged. If costs exceeding 50% of the course fees have been incurred, this amount will be deducted from the refund. In case of cancellation within 14 days before the start of the course, the full course fees will be charged.
  • 6.3 The Entrepreneur reserves the right to cancel or modify a course in the event of insufficient participants or other unforeseen circumstances. In such cases, the consumer is entitled to a full refund of the paid course fees.
  • 6.4 Scheduled lesson dates can be changed up to 48 hours before the start of the lesson, only if a significant reason is provided. Non-refundable costs incurred will be charged to the participant.
  • 6.5 In case of cancellation within 48 hours before the start of the session, or changes, or missing lessons without providing a reason, the fees as described in Article 6.7 will be charged.
  • 6.6 Missed lessons must be rescheduled and completed at a later date to complete the course.
  • 6.7 The following rates apply for make-up lessons:
    • Theory lesson: €29.50 per session
    • Pool lesson: €39.50 per session
    • Open/confined water lesson: €59.50 per session

7. Cooling-Off Period and Exceptions

  • 7.1 The consumer has the right to cancel the agreement without giving reasons within 14 days of the day on which the agreement was concluded (cooling-off period).
  • 7.2 During the cooling-off period, the consumer may assess the product/service as they would in a store. The consumer may not use the product or fully execute the service.
  • 7.3 If the consumer wishes to exercise the right of withdrawal, they must notify the Entrepreneur in writing or electronically within the cooling-off period.
  • 7.4 If the consumer uses digital learning materials or has already attended a course day within the cooling-off period, the costs for the provided learning materials and the attended course day will be charged. These costs will be calculated proportionately.

8. Liability and Insurance

  • 8.1 The Entrepreneur is not liable for any damage resulting from participation in the course, unless the damage is due to intent or gross negligence on the part of the Entrepreneur.
  • 8.2 The consumer must ensure adequate (diving) insurance or arrange it through the Entrepreneur for the duration of the course.
  • 8.3 The participant shall not hold the Entrepreneur, the diving federations SDI and/or International Training and/or TDI, or diving insurance providers DAN, or any officials of these organizations liable for any loss of personal belongings.

9. Privacy and Data Protection

  • 9.1 The Entrepreneur respects the privacy of the consumer and ensures confidential treatment of personal data.
  • 9.2 Personal data will only be used to the extent necessary for the execution of the agreement and will not be provided to third parties without the consumer’s consent, unless legally required.
  • 9.3 The Entrepreneur is required to securely retain the participant’s training dossier for administrative purposes for 7 years, after which the data will be securely destroyed. The training dossier contains the following information about the participant:
    • Name, address, telephone number, email address, date of birth, gender, occupation, completed courses or diving certifications and corresponding graduation dates, medical statement, General Liability Waiver and Risk Acceptance.
    • Emergency contact(s) details: Name, address, relationship, telephone number(s)
  • 9.4 This will be done in compliance with applicable privacy legislation (GDPR). For more information, see the privacy statement on the website.

10. Force Majeure

  • 10.1 The Entrepreneur is not liable for any failure to perform its obligations under the agreement if the failure is due to circumstances beyond the reasonable control of the Entrepreneur. This includes, but is not limited to, natural disasters, war, strikes, pandemics, or other force majeure situations.
  • 10.2 In the event of force majeure, the Entrepreneur will inform the consumer as soon as possible and make reasonable efforts to mitigate the impact of the force majeure situation. The Entrepreneur reserves the right to suspend or cancel the execution of the course or service without being liable for any compensation.

11. Complaints Procedure

  • 11.1 If the participant has a complaint about the execution of the agreement, the Entrepreneur would like to hear this. Please send the complaint as soon as possible (and as detailed as possible) to info@dibdiving.com. The Entrepreneur will address the complaint as quickly as possible, no later than five days after receiving the complaint. If the complaint cannot be resolved within the previously mentioned time period, the participant will receive a confirmation of receipt of the complaint within five days and will be informed of when a substantive response is expected. If the Entrepreneur and the participant cannot resolve the complaint amicably, a dispute will arise that falls under the dispute resolution procedure.

12. Dispute Resolution

  • 12.1 Dutch law exclusively applies to all legal relationships involving the Entrepreneur.
  • 12.2 Disputes between the Entrepreneur and the consumer will be submitted to the competent court in the district where the Entrepreneur is located, unless the law prescribes otherwise.
  • 12.3 The consumer can also access the ODR platform (Online Dispute Resolution). This platform provides an out-of-court resolution.

  • 1.1 De Ondernemer: De natuurlijke of rechtspersoon die een overeenkomst aangaat met betrekking tot het aanbieden van opleidingen, duikcursussen, EHBO-cursussen, reanimatie, zuurstoftoediening, bloedoverdraagbare aandoeningen of andere aangeboden cursussen/producten. Hiermee wordt DIB Diving bedoeld.

  • 1.2 Consument/Klant/Deelnemer: Een natuurlijk persoon die niet handelt in de uitoefening van een beroep of bedrijf en een overeenkomst aangaat met de Ondernemer betreffende een product en/of dienst en/of cursus en/of opleiding aangeboden door de Ondernemer.

2. Algemeen

  • 2.1 Deze Algemene Voorwaarden zijn van toepassing op alle aanbiedingen, offertes, overeenkomsten en leveringen van diensten en producten door of namens de Ondernemer.
  • 2.2 Afwijkingen van deze Algemene Voorwaarden zijn slechts geldig indien uitdrukkelijk schriftelijk overeengekomen door beide partijen.
  • 2.3 Indien één of meerdere bepalingen uit deze Algemene Voorwaarden op enig moment geheel of gedeeltelijk nietig zijn of vernietigd worden, blijven de overige bepalingen volledig van kracht.

3. Verplichtingen van de Deelnemer

  • 3.1 Elke cursus bevat specifieke voorwaarden en eisen waaraan de deelnemer moet voldoen om deel te nemen. De bijbehorende formulieren zijn beschikbaar bij de cursusinformatie en worden geacht voorafgaand aan inschrijving gelezen te zijn.
    • SDI – Algemene aansprakelijkheidsverklaring en risicobevestiging
    • SDI – Medische Verklaring
    • SDI – Normen voor de desbetreffende cursus
    • Mogelijk andere formulieren
  • 3.2 Deelname aan de cursus is alleen mogelijk indien de relevante formulieren naar waarheid zijn ingevuld, ondertekend en uiterlijk op de eerste cursusdag zijn ingeleverd.
  • 3.3 De formulieren dienen op verzoek getoond te worden. Indien dit niet mogelijk is, kan de Ondernemer de deelnemer uitsluiten van deelname.
  • 3.4 De Ondernemer mag uitgaan van de juistheid van de door de deelnemer verstrekte informatie.
  • 3.5 De deelnemer dient zorgvuldig om te gaan met het door de Ondernemer beschikbaar gestelde (duik)materiaal. Verlies of schade kan worden doorbelast.
  • 3.6 De deelnemer houdt zich aan de regels van de Ondernemer en de huisregels van de leslocaties.

4. Aanbod en Overeenkomst

  • 4.1 Alle aanbiedingen van de Ondernemer zijn vrijblijvend, tenzij uitdrukkelijk anders vermeld.
  • 4.2 De overeenkomst komt tot stand wanneer de consument het aanbod van de Ondernemer aanvaardt en aan de gestelde voorwaarden voldoet.
  • 4.3 De Ondernemer bevestigt de overeenkomst schriftelijk of elektronisch aan de consument.

5. Prijzen en Betaling

  • 5.1 Alle prijzen zijn in euro’s en inclusief btw, tenzij anders vermeld.
  • 5.2 Betaling dient te geschieden binnen 14 dagen na factuurdatum.
  • 5.3 Bij niet tijdige betaling is de consument van rechtswege in verzuim en wettelijke rente verschuldigd.
  • 5.4 Een cursus of e-learning wordt pas gestart nadat volledige betaling is ontvangen.

6. Annulering en Wijziging

  • 6.1 Annulering dient schriftelijk te gebeuren.
  • 6.2 Bij annulering tot en met 14 dagen voor aanvang van de cursus wordt 50% van het cursusgeld in rekening gebracht.
  • 6.3 De Ondernemer behoudt zich het recht voor een cursus te annuleren bij onvoldoende deelnemers.
  • 6.4 Lesdata kunnen tot 48 uur vooraf gewijzigd worden.
  • 6.5 Bij wijziging of afmelding binnen 48 uur worden de standaardtarieven in rekening gebracht.

7. Herroepingsrecht

  • 7.1 De consument heeft recht op herroeping tot 14 dagen na totstandkoming van de overeenkomst.
  • 7.2 Indien de consument gebruik wil maken van het herroepingsrecht, dient dit schriftelijk of elektronisch aan de Ondernemer te worden gemeld.

8. Aansprakelijkheid en Verzekering

  • 8.1 De Ondernemer is niet aansprakelijk voor schade voortvloeiend uit deelname.
  • 8.2 De consument dient zelf te zorgen voor een adequate (duik)verzekering.

9. Privacy en Gegevensbescherming

  • 9.1 De Ondernemer respecteert de privacy van de consument en behandelt persoonsgegevens vertrouwelijk.
  • 9.2 Gegevens worden uitsluitend gebruikt voor uitvoering van de overeenkomst.

10. Overmacht

  • 10.1 De Ondernemer is niet aansprakelijk voor het niet nakomen van verplichtingen door overmacht.

11. Klachtenprocedure

  • 11.1 Bij klachten kan contact worden opgenomen via info@dibdiving.com.

12. Geschillenregeling

  • 12.1 Op alle rechtsverhoudingen met de Ondernemer is uitsluitend Nederlands recht van toepassing.
  • 12.2 Geschillen worden voorgelegd aan de bevoegde rechter in het arrondissement van de Ondernemer, tenzij wettelijk anders bepaald.
  • 12.3 De consument kan ook gebruikmaken van het ODR-platform (Online Dispute Resolution) voor buitengerechtelijke geschillenbeslechting.
